| Judicature Appraisal for Intellectual Property (IP) in China
IP Judicature Appraisal came into being in the 1990s due to the establishment of the IP Protection System and the need for judicature trials in China. IP Judicature Appraisal is a type of empirical scientific activity used in the process of litigation and its aim is to assist judicature and law enforcement departments identify and/or investigate the facts of cases and then to make right decisions.
The Status of Judicature Appraisal in the Judicature Procedure
According to relevant Chinese law, the process of Judicature Appraisal not only is a necessary judicial proceeding, but also is a means of establishing conclusions that have the status of legal evidence in Chinese civil, criminal and administrative litigation. As legal evidence, due to the neutrality, impartiality and scientific nature of Judicature Appraisal, its appraisal conclusions have greater power than statements of related parties and witnesses (including expert witnesses).
The Effect of Judicature Appraisal in the Judicature Procedure
The conclusions of Judicature Appraisal, in the form of an appraisal report, are important legal bases for the adjudication of cases by Chinese judicature and law enforcement departments. Judicature Appraisal provides powerful support to judicature and law enforcement departments in solving IP disputes, protecting IP rights, and stopping infringement.
In litigations that are proceeding, the appraisal report will play an important role because it will enable the parties to objectively understand the disputed facts, grasp the initiative in the litigation, reduce litigation risk, and reduce litigation cost.
When litigation is not currently in progress, judicature appraisal can help the parties to judge whether their rights are legal and whether there is an infringement of their IP rights so that they can choose a proper method to resolve the dispute.
The Types of IP Judicature Appraisal
IP judicature appraisal involves infringement appraisal which covers patent, trademark, copyright and business secrets, etc. It refers to an appraisal based on a comparison between the legal documents that owners of lawful IP rights have and the physical objects that are suspected of being infringements of their IP rights.

| Founded in 1999 and ratified and chartered by the Supreme Court of the People's Republic of China and the Ministry of Justice of the People's Republic of China, Beijing JZSC Judicature Appraisal Center for Intellectual Property is the largest judicature appraisal body for intellectual property with great authority. We have the largest number of appraisal experts and appraisal fields in the People's Republic. Furthermore, JZSC is also the only judicature appraisal body which has foreign IP experts working as their appraisal observers.
Through the links and connections built between our center and our overseas appraisal observers, we can help more foreign enterprises and individuals solve their current or potential IP disputes, and this will then bring about enhanced confidence in the Chinese IP protection system.
Foreign appraisal observers need to get a full and in-depth understanding about Chinese IP law and the Judicature Appraisal System. So in order to help them get this, once appointed, foreign appraisal observers can come to our center to accept training. Our center, on invitation, can also visit the firms of foreign appraisal observers to give them onsite lectures and training.
So far, we have appointed 64 appraisal observers from Japan, Republic of Korea, USA, Singapore, Philippines, and Taiwan. They have already got a fairly deep understanding about the Chinese IP System by attending seminars. They have also been getting practical experience by attending meetings of our technology and law experts about clients for some specific cases in China. These meetings discuss and analyze these cases' litigation prospects. Through their personal participation, they have gained a realistic experience and a full understanding about the objectivity, impartiality, and the scientific nature of our appraisal methods. They have also gained a realistic experience and full understanding of the function, role and effect of judicature appraisal. The presence and status of them as appraisal observers has greatly benefitted them in knowing how to deal with Chinese IP matters.

| If you are interested in becoming an IP Judicature Appraisal Observer of Beijing JZSC and if you accord with ONE of the following conditions, you may apply for the position of Observer:
1. Working as a qualified Advocate (Lawyer, Solicitor or Attorney, Judge) in IP areas for not less than 2 years;
2. Having education background or working experience in technical, science (prefer natural science) or engineering fields;
3. Being engaged in IP services/or involved in IP services in certain country for not less than 3 years.
